Terms and Conditions

These are the terms and conditions for Fourmiliere Chalets SARL of 29 Chemin des Granges, 74100 Morzine, France, hereafter referred to as Chalet Fourmiliere, and abbreviated to ‘CF’.

This document, together with your booking form, comprises the contract between Fourmiliere Chalets SARL and all persons listed on the Booking Form. The Contract is deemed to come into effect as soon as the Booking

Form has been sent and completed by the Lead name, accompanied by either a non-refundable deposit, or full payment.

By completing a booking form the Lead name agrees on behalf of all listed members that:

He/she has read the terms and conditions, and agrees that all members of the group are bound by them.

  • He/she is over 18 years old.
  • He/she consents to our use of information as stated in our privacy policy.
  • All information provided to CF is correct and accurate.
  • The Lead name is responsible, on behalf of all members of the Group, for all matters
    relating to the booking, thus he/she will be personally liable for all monies outstanding from
    the remainder of the guests listed on the booking form.
  •  The Group refers to all persons booked to stay at CF and also includes any subsequent
    changes of name made after the original booking.
  • If at any time prior to the holiday there is a change of Lead name, CF must be notified in
    writing.
  • Under no circumstances are additional guests allowed to stay in CF, other than those
    specified on the Booking Form. Failure to comply with this may result in your booking
    being terminated immediately and your party being asked to vacate CF immediately. No
    compensation will be paid for this.

Booking Terms

Once availability of CF has been confirmed a reservation is only valid on payment of a non-refundable deposit of 25% of the total cost. A booking enquiry will not be held until this deposit is received. A completed booking form must then be received within 7 days to completethe reservation. The final balance outstanding on your holiday must be paid 10 weeks before the start date. Bookings made within the 10 week start date period will require payment of the full cost of your holiday at time of booking to secure your reservation. If the final balance is not received CF reserve the right to cancel the booking and to retain any deposit paid, they may re-book the same week in the Chalet to another client without further notification.

If you agree to reserve the whole chalet on an exclusive basis the Lead name is liable for the full cost of the property, as stated on your Booking Form, irrespective of party size and final number of guests confirmed. Your party size cannot exceed the agreed maximum capacity of CF, which is, up to a total of 15 adults or children.

In the case of a whole chalet booking, payments on behalf of the Group must be made in one lump sum by the Lead name. This applies to both deposits and final balances. CF cannot accept multiple payments from multiple individuals for group bookings.

Prices and Payment

For exclusive use weeks the price quoted is irrespective of number of guests, up to the maximum capacity, detailed above.

Prices quoted are for catered accommodation for one week (7 nights), with evening meals on 6 nights, breakfast on 7 mornings, afternoon tea on 7 days, specially selected drinks and driver service.

Prices do not include: lift passes, equipment hire, lessons, flights, transfers, other travel costs, holiday / medical insurance, childcare, or anything else not specifically stated. CF guarantees the price of your holiday as quoted at the time of booking and as stated on your booking form but reserve the right to increase or decrease the advertised price of unsold holidays at any time.

CF reserve the right to charge for damage, loss, breakages and additional cleaning fees caused as a result of any the Group during their stay.

CF will not be held responsible for charges incurred by yourself for international bank transfer costs or charges made by you or our bank / card issuer. This includes payment discrepancies or additional costs caused by variations in exchange rates used by your bank / card issuer.

In the event of dishonored payments the Lead name will be responsible for making immediate payment by other means. Failure to make this payment means we reserve the right to cancel the booking, retain any deposits and levy cancellation charges as detailed below. In this instance CF reserve the right to re-book the same week to another client without notification.

Any charges or loss of revenue incurred by late payment of monies due to CF will be added to your final balance. CF reserve the right to cancel your holiday should you fail to pay your final balance. No compensation will be due from CF in this instance.

Definitions of terms used below – ‘holiday’ means accommodation and meals as detailed only. Transfers, lessons, ski hire, spa treatments and childcare are deemed as extra and not considered as part of the term ‘holiday’.

Arrival & Departure Times

We work hard to ensure that on changeover days your room is ready for your arrival and in order to ensure this we ask that you arrive after 3pm and rooms are vacated by 10am on your day of departure. Luggage storage is available should your resort departure time be later than this. We will do our best to keep you entertained if your arrival / departure times are different to this although there may be a small delay in checking you into your room

Cancellation

Should you need to cancel your booking for any reason, the following cancellation charges apply. Charges are calculated in relation to the time before the arrival date at which the notice is received.

  • More than 6 weeks in advance – 25% of holiday cost;
  • 4-6 weeks – 50% of holiday cost;
  • 2-4weeks – 75% of holiday cost;
  • Less than 2 weeks – 100% of holiday cost.

When a last minute booking is cancelled i.e. a booking made 2 weeks or less prior to the Arrival Date, we reserve the right to withhold 100% of the amount paid. We will make every effort to resell your holiday and if we are successful we will refund up to 60% of your holiday cost. The amount refunded will be determined by how much our administration team has done for you i.e. booked transfers, lessons, ski hire etc.

In the unlikely event of circumstances arising that are outside of CF’s control, it may be necessary to make alterations to a confirmed holiday or indeed to cancel the holiday completely. Whilst CF will make absolutely every effort to ensure this does not happen, in the event of it being unavoidable, CF will contact the Lead name as soon as possible. In this instance CF will endeavor to make alternative arrangements for accommodation of a similar standard, if available, or if we cannot find alternative accommodation that is acceptable to you, we will then offer a full refund of the cost of monies paid to CF for your holiday. No other compensation will be offered and CF will not be liable for any of the additional costs for transfers, lift passes, lessons, ski hire, spa treatments etc. It is at the discretion of each of these companies to offer refunds to you and if CF is unable to contact these companies for you, you will become responsible for contacting each of these companies.

Travel Insurance and Safety

Winter/Mountain sports and travel involve a degree of risk and therefore we strongly recommend that you and your party take out full Winter Holiday Travel and Medical Insurance. Your booking with us is made on the assumption that each guest will have arranged such insurance.

All Clients are responsible for their own safety, personal possessions, ski equipment and vehicles.

Any guests travelling with medication and / or a pertinent medical requirement / condition / allergy should advise CF before their stay. While CF will endeavor to help in any emergency situation we are not medically trained and therefore cannot be held accountable or responsible should a medical emergency situation arise.

Your safety is paramount and while team CF will always do their best to ensure the safety of our guests it is your responsibility to familiarize yourself with safety protocol, fire exits and fire extinguishers in the property when you arrive.

Use of the Hot Tub

Use of the Hot Tub is at your own personal risk and no responsibility can be taken for accidents or injury sustained as a result. No smoking or glass is allowed in the hot tub – we supply plastic glasses for your use. Persons under the age of 16 must be supervised at all times by a responsible adult from your party. In consideration to our neighbours, use of the Hot Tub is not permitted between the hours of 10pm and 8am.

Damages, Loss, Additional Cleaning, Theft and Breakages

Access to CF is by means of a high security key fob. This offers safety and security to all and provides guests with independent access through the front door. Loss of the key fob will incur a €50.00 replacement cost being charged to the client, payable prior to departure.

Should any items or property of CF be lost or damaged during your stay please notify CF immediately. CF reserve the right to make a charge for any loss or damage caused by any member of the group and this must be paid for, in full, by the lead name before departure. CF will not be held responsible for any theft or loss of any personal possessions from our premises or vehicles. While CF will endeavor to ensure the security of guest’s personal possessions we cannot guarantee this and each guest is responsible for the safety of all their own personal possessions, documents and equipment. No responsibility or liability will be accepted in respect of such items and it is a condition of your booking that guests have adequate insurance to cover loss and / or damage. This applies to any sporting equipment and any other high value items guests may have bought with them.

Our Liability

We promise to make sure that all aspects of the holiday we have agreed to arrange, perform or provide as part of our contract with you are performed or provided with reasonable care and skill. We shall not be liable for any loss; delay or costs incurred arising from circumstances outside our control (including weather, traffic and snow conditions, limitations imposed by resort authorities, ski lifts, ski school or ski hire operators). In any event, our maximum liability to any client (other than in respect of death or personal injury caused by the Company’s negligence) shall be the amount received by us from such client for their holiday.

Complaints

We understand how important guest happiness is and work hard to ensure that expectations are not only met but, we hope, exceeded. However if a problem does occur during your holiday, please tell us so that it may be addressed immediately. Grievances that are only shared after your holiday do not allow us to help you at a time where we can make a difference and as such cannot be entertained.

Descriptions

All descriptions on the CF web site or in any written or oral communication from CF are given in good faith and in the belief that they are true. Should any significant details change before your holiday we will do our best to inform you.

Responsibilities and Behaviour

Guests should act in a way that is respectful to staff, other guests and local residents. CF will not be held in any way responsible for any official fees, fines or charges incurred for noise, breach of peace, or, any other misbehaviors. In exceptional circumstances CF reserves the right to refuse to further accommodate guests in breach of this, with all contractual obligations being immediately terminated and no compensation payable. In order to respect our neighbours and other guests we observe a 10pm outside noise curfew. CF reserve the right to turn off and/or remove music devices, hot tub etc after this time.

The use of illegal substances within CF is not tolerated. We reserve the right to evict from the property anyone found to be using or supplying such substances with immediate effect. No compensation will be paid.

Smoking within CF is strictly forbidden in compliance with French fire regulations. Those wishing to smoke should do so outside the property, disposing of cigarette butts in the provided receptacles.

Data Protection and Privacy

CF is committed to protecting your personal data and to respecting your privacy. We use your personal information only in order to provide you with information and services concerning your holiday at CF. Your personal data will not be used for any other purpose and will not be shared with any third party outside of the suppliers and service providers connected with your holiday at CF.
